In 1893, SCOTUS classified the tomato as a vegetable in Nix v. Hedden, based on the wisdom of knowing their usage was the same as vegetables, and not used in fruit salad. So, for the purposes of commerce, tomatoes ARE a vegetable and would be subject to any taxes specifically on vegetables but not on fruits, such as the Tariff Act of 1883. http://caselaw.lp.findlaw.com/scripts...
